The Lexington County Adult Drug Treatment Court (Drug Court) is a diversion program provided and operated by the Eleventh Circuit Solicitor, S.R. Hubbard III. Drug Court is a court-supervised, multi-agency, community-based alternative to traditional prosecution for high risk and high needs offenders. Typically, participation in the program varies between eighteen (18) and twenty-four (24) months, but recovery is an individual process that may be longer than 18-24 months depending on the individual’s needs and progress. The program is a collaboration of a multi-disciplinary team, which includes prosecutors, defense attorneys, judges, law enforcement officers, probation agents, treatment providers, and other community resources.
Referrals to Drug Court can be made by various parties; however, the Solicitor has the sole authority, pursuant to his prosecutorial discretion, to determine who may enter the program. Those eligible for Drug Court are non-violent offenders with pending General Sessions charges and/or pending probation violations, who are at serious risk of lengthy prison sentences or death due to their severe substance abuse disorder. If an offender meets all criteria through the screening process and is deemed high risk/high needs, that offender is eligible to enter the program via a negotiated plea or a restructuring of the terms and conditions of their probation.
Once accepted into the program, a participant is required to submit to mandatory drug testing, participate in intensive outpatient treatment, attend bi-weekly court sessions, attend community support groups, and complete various assignments as required by the treatment staff. While primarily a therapeutic program designed to assist participants in their rehabilitation, Drug Court stresses accountability, and those who fail face certain legal punishment. Sanctions may be ordered by the judge periodically for non-compliance with program requirements, and termination from the program may be ordered in cases of continued non-compliance. In cases of termination, a participant will be taken into custody and brought before a General Sessions judge for imposition of their negotiated sentence. Incentives are also given to encourage continued compliance; and, upon graduation, a participant will have the opportunity to have their criminal record expunged of all legally eligible convictions and/or charges from the Eleventh Judicial Circuit.
